Photo Policy

Japanese Garden of Phoenix, Inc. (JFG)

If the garden staff assigned to your photoshoot finds any activities beyond photography being performed, including marriage ceremonies or advertisement/commercial filming, you will be subject to a $650-$1,700 charge to the credit card on file. 

Any time past the 1 hour will be subject to an additional $50 charge. 

 

With the charge of $300 there will be no more than 10 guests in your party allowed in the garden at once during your time. You may switch your guests out during your allotted rental time. However, the garden staff assigned to the shoot must be aware of this and must do a head count prior to switching out guests. 

1.PHOTO POLICY/GARDEN ETIQUETTE: 

All guests, including those in scheduled photography sessions must follow our Garden’s rules and etiquette which include: 

  • Please stay on the path at all times. Do not climb trees, sit on rocks or enter waterfall/vegetation areas. Children must be supervised by an adult at all times. 

  • Please leave food and drinks (except water) outside of the garden. 

  • Pets, with the exception of service animals, are prohibited in the garden. 

  • To maintain the quietness and serenity of the garden, please refrain from using loud voices, shouting or running. The JFG is a place of meditation and contemplation, so walk slowly, relax and enjoy the tranquil beauty of the garden. 

 

2.CANCELLATION/WEATHER: 

No refund is available if cancellation notice is received less than one week prior to event; entire payment will be forfeited to the Japanese Friendship Garden. Allow approximately four weeks for a refund to be processed, if applicable. 

The JFG shall assume no liability or expense for inclement weather that affects the User’s event or for any occurrence that may impact the event, which is outside the JFG’s control. The JFG does not provide any equipment other than what is designated under this contract. 

The JFG reserves the right to determine if weather conditions warrant a cancellation/rescheduling. A full refund, minus the processing fee, will be given with the JFG’s approval in the case of strong winds and/or heavy rain at the time of the event and the User chooses to cancel. 

 

These agreements are subject to cancellation pursuant to A.R.S. 38-511. 

  

3.LICENSES/LAWS:   

Users shall obtain all permits or licenses required by law, ordinance, or Parks department rules or regulations. It will be the responsibility of the User to follow all applicable local, state, and federal safety rules and regulations and to maintain safe conditions for workers, activity patrons and the public. 

 

4.SAFETY: 

It will be the responsibility of the User to follow all applicable local, state, and federal safety rules and regulations and to maintain safe working conditions. Staff may stop hazardous activities or the use of a particular tool or piece of equipment, which the JFG deems unsafe. Children must be supervised while they are at the Garden. 

 

5.SUPERVISION OF MINORS:         

An adult must be present at all functions that involve minors. The party signing the Facility Use Agreement must be 18 years of age or older. 

 

6.DISORDERLY CONDUCT: 

JFG reserves the right to eject or cause to be ejected from the facility any disorderly person(s). Neither the JFG nor its staff shall be liable to the User for damages that may result upon such action. 

 

7.DAMAGE:       

Any damage resulting from the use of the facility or equipment of the facility shall be paid by the User or deducted from the deposit. The User agrees to take the utmost care not to damage any of the Garden facilities and landscape.  The User will be responsible for all damages to landscape, buildings, equipment, fixtures, and furniture arising out of the use of the premises.  In addition, the Garden/City will not be liable to the User, its guests, agents, performers, or employees for any personal property. The User is responsible for the behavior of guests while they are on the grounds of the Garden. 

 

8.ALTERATIONS/DECORATIONS: 

Users will not be allowed to temporarily or permanently alter any features of the facility or the surrounding areas. The Garden facilities are rented “as is.” 

  • Decorations must be approved in advance. 

  • Nothing may be placed on fences or fence gates. 

  • Signage must be approved by the JFG staff in advance. Plants brought into the Garden must be clean and free of pests. 

No fireworks or pyrotechnic devices are permitted in the garden. NO RICE, GRASS OR FLOWER SEED, BIRDSEED, CONFETTI, OR FAKE FLOWER PETALS ARE ALLOWED TO BE THROWN IN THE GARDEN. 

  

9.LIABILITY:  

User agrees to indemnify, defend and hold the JFG harmless from any and all liability, damages, costs and expenses in connections with any and all claims, actions or causes for injury, death or property damage arising from or out of the use and occupancy of the facility. The JFG does not accept responsibility for any injuries that may occur.

 

10.ADA ACCESSIBILITY:          

The Garden parking, restrooms, and facilities are accessible for wheelchairs and motorized scooters.
